Jurisprudential Foundations and Institutional Construction of Special Legislation on Pre-prepared Dishes from the Perspective of the Greater Food Approach

Abstract: The greater food approach not only provides a new theoretical perspective for safeguarding food security in the new era, but also establishes value guidance for the institutional construction of a diversified food supply system. As an important product of food industrialization and supply-chain modernization, pre-prepared dishes have become a significant component of the modern food supply system. However, the existing regulatory framework suffers from fragmented institutional supply, imprecise conceptual definition, and inadequate protection of consumer rights, making it difficult to respond effectively to the demands of industrial development and to public concerns. Against this background, it is necessary to advance special legislation on pre-prepared dishes under the guidance of the greater food approach. In terms of legislative philosophy, such legislation should be guided by the fundamental goals of safeguarding food safety, promoting the standardized development of the industry, and protecting consumer rights and interests. In terms of institutional functions, it should integrate risk regulation, market governance, and rights protection. In terms of institutional design, it should focus on the systematic construction of core definitional rules, the allocation of regulatory powers and responsibilities, and information disclosure mechanisms to achieve a normative balance among the bottom line of safety, industrial development, and consumer protection, thereby providing legal support for the implementation of the greater food approach.
