食品正义导向下的食品体系重塑与立法回应

摘要: 立法旨在保障人人有权获得数量适足且质量安全的食物。然而,食物权的实现仍面临多重障碍:一是社会经济不平等导致食物分配不公,使弱势群体难以公平获取安全且营养的食品;二是非传统食品安全风险、利益驱动型食品欺诈等新型挑战持续威胁公众健康;三是食物权的实现还需统筹应对粮食安全、食品可持续等交织性议题。为了弥合不同群体在权利实现方面的差距,实现健康、平等、自由这3 个关联正义的价值,食品正义从环境正义的附属主张发展为了基于食物权的独立诉求。这一发展正深刻推动着许多国家和地区的食品政策和法律创新,以期借助市场选择和社会参与,对权益受损群体进行充权赋能,并最终实现人人享有尊严、健康且可持续的饮食未来。

Abstract: Legislation aims to protect the right of every person to adequate and safe foods. However, the right to food is still hampered by multiple obstacles. First, socio-economic inequalities lead to inequitable food distribution, making it difficult for vulnerable groups to gain equitable access to safe and nutritious foods. Second, emerging challenges such as non-traditional food safety risks and economically motivated food fraud continue to threaten public health. Third, fulfilling the right to foods requires addressing interconnected issues including food security and food sustainability. To bridge the gaps in the realization of this right among different groups, and to realize the three justice-related values of health, equality, and freedom, food justice has evolved from an adjunct to environmental justice to an independent claim based on the right to foods. This development is driving innovation in food policies and laws across many countries and regions. It aims to empower disadvantaged groups through market choices and social participation, ultimately advancing toward a future where everyone enjoys dignified, healthy, and sustainable diets.
